Definitions

Application Form means the Tasmanian Racing C-19 Welfare Package Application Form available online at tasracingcorporate.com.au

 

In Work means preparing, educating and exercising of a horse or greyhound located in Tasmania.

 

ORI means the Office of Racing Integrity

 

Steward has the meaning given in the Racing Regulation Act 2004 (Tas)

 

South, North, North-West regions and regionalised north/south model have the same meanings given in the Return to the Racing Plan.

 

Tasracing means Tasracing Pty Ltd

 

Trainer means a thoroughbred, standardbred or greyhound trainer that is licensed or exempted by ORI to train horses or greyhounds in Tasmania (excluding King Island).  For the greyhound code only, the definition of a Trainer also includes greyhound licensed participants.
Update Form means the Tasmanian Racing C-19 Welfare Package Update Form available online at tasracingcorporate.com.au

 

Welfare Package means the Tasmanian Racing C-19 Welfare Package
  1. animals In Work for the purpose of preparing those animals for races are eligible to claim the Welfare Package relevant to the code of racing.
  2. animals In Work but able to compete in a race for prizemoney are not eligible for the Welfare Package.
  3. For the greyhound code, animals In Work include racing dogs, breeding dogs and pups over six (6) weeks of age and the definition of a Trainer also includes greyhound licensed participants.
  4. Trainers are to apply for the Welfare Package as the responsible person for the welfare of the animals In Work. If you are unsure whether your animal qualifies for the Welfare Package, contact Tasracing or ORI or provide information relating to your animal when nominating it as an animal In Work to allow Tasracing to make an appropriate determination.
    1. The Welfare Package will apply from 1 April 2020 to 30 April 2020 (Initial Term).
    2. At the expiry of the Initial Term, the Welfare Package will be extended for a further term from 1 May 2020 to 31 May 2020 or an earlier date announced by the Government to resume racing in Tasmania (Second Term).
    3. If racing is resumed during the Second Term based on the regionalised north/south model, the Welfare Package:
      1. will not apply to Trainers in the North and South regions; and
      2. will only apply to Trainers in the North-West region that have animals In Work, except for those Trainers that transport the animals In Work from the North-West region to the North or South regions to compete in races. If animals are eligible to compete in a race, then these animals are not eligible for the Welfare Package.
    4. Tasracing will continue to review the Welfare Package arrangement in line with the Government’s decision regarding the status of racing in Tasmania.
  5. Trainers must apply for the Welfare Package and nominate each animal that is In Work. The Trainer acknowledges that to be eligible for the Welfare Package, the animal(s) nominated for the scheme must be In Work during the Term.
  6. The eligibility criteria for each code of racing is provided in the following sections. Tasracing recognises that not all circumstances of animal In Work are covered in the criteria due to the speed at which the Welfare Package has been established. We request that you contact Tasracing for a decision if you require clarification on the criteria.

    Refer to sections 16 – 21 for Thoroughbred Racing Welfare Package criteria;
    Refer to sections 22 – 29 for Harness Racing Welfare Package criteria; and
    Refer to sections 30 – 34 for Greyhound Racing Welfare Package criteria.

  7. To apply for the Welfare Package the Trainer must complete the Application Form, which includes the acceptance of these terms and conditions, a declaration statement and privacy statement, and submit it to Tasracing via online or email it to racing@tasracing.com.au or via post to PO Box 730 Glenorchy TAS 7010.
  8. The amounts to be paid under the Welfare Package will be calculated on a daily charge for thoroughbred and harness horses and a weekly charge for greyhounds (Payment). The Payment will be back paid to the commencement date of 1 April 2020 or the date the animal became eligible for Payment (whichever is the latter). It will be paid on a weekly basis in arrears and on a day (code specific) determined by Tasracing on approval of the application.
  9. Data matching will be undertaken by Tasracing and ORI. The final decision whether to include an animal as an animal In Work for the purpose of the Payment will be determined by ORI. Tasracing will consult with ORI prior to the application being approved. If any data is intentionally falsified, further Payments will cease and the Trainer will be required to repay the specific Payments received and will be excluded from the scheme, including any future schemes. If an unintended data error has occurred, further Payments will cease and the Trainer will be required to repay the specific Payments received but will not be excluded from the scheme, including any future schemes, once the error has been rectified.
  10. Tasracing reserves the right to recover any overpayments made to a Trainer. The Trainer acknowledges that he/she is personally and solely responsible for the repayment of any overpayment.
  11. If the horses/greyhounds in the Trainer’s care change (i.e. a horse/greyhound is no longer eligible or becomes eligible), the Trainer must notify Tasracing of that change as soon as possible by submitting the Update Form.
  12. The Trainer agrees to provide information to Tasracing promptly to verify the data submitted by the Trainer in the Application Form and Update Form, and assist Tasracing with auditing of data (if required).
  13. The Trainer fully and unconditionally agrees and acknowledges that Tasracing reserves the right to amend these terms and conditions without notice or compensation. Tasracing’s decision on all matters relating to the Welfare Package is final and binding.
  14. If a dispute arises between the Trainer and Tasracing in connection to the Payment(s) under the Welfare Package, it will be referred to the panel comprising the Director of Racing (ORI) and CEO of Tasracing (the Panel) to resolve. The decision of the Panel is final and binding.
  15. Making an application and receiving Payments under the Welfare Package does not preclude the Trainers from applying for any other Federal or State Government incentive or assistance packages.
  16. Thoroughbred Racing Welfare Package Criteria

  17. No payment will be made for a thoroughbred horse that is spelling. Payments are only for eligible thoroughbred horses In Work.
  18. Payments under the Welfare Package will be made to Trainers as the responsible person for welfare for eligible thoroughbred horses In Work.
  19. Each of the nominated thoroughbred horses that are classified as In Work in the Application Form will be verified against the stable returns for last two months. If there is insufficient or ambiguous data, then Tasracing shall consider the number of starts in the last two months as a method of verification (excluding un-raced horses).
  20. Tasracing acknowledges that thoroughbred horses may go out of work and/or another come In Work and/or be transferred to another trainer if the cessation of racing is extended beyond the Term. In the event of these situations, the Trainer must notify Tasracing of the changes by completing the Update Form as soon as possible. If the updates are not notified to Tasracing and there is a discrepancy between the nominated horses in the Application Form and the horses In Work on inspection by the Stewards, the Trainer will be required to repay any overpayment as determined by Tasracing in consultation with ORI.
  21. Thoroughbred horses In Work that are un-named must be approved by the Stewards to be eligible under the scheme. A pre-trainer whose intention is to transfer the horse directly In Work under a Trainer, barring any unforeseen circumstances, will be eligible to apply for the Welfare Package. If there is insufficient or ambiguous data, the Stewards will determine the eligibility. The Steward’s decision will be final and binding with respect to the eligibility of the horse.
  22. The day rate for a thoroughbred horse In Work is $45 per calendar day plus GST (where applicable).
  23. Harness Racing Support Package Criteria

  24. No payment will be made for a standardbred horse that is spelling. Payments are only for eligible standardbred horses In Work.
  25. Payments under the Welfare Package will be made to Trainers as the responsible person for welfare for eligible standardbred horses In Work.
  26. Each of the nominated standardbred horses that are classified as In Work in the Application Form will be verified against the stable returns for last two months. If there is insufficient or ambiguous data, then Tasracing shall consider the number of starts in the last two months as a method of verification (excluding un-raced horses).
  27. Standardbred horses that are 4YO or older and have not started in the last six (6) months are automatically excluded unless certified as eligible by the Stewards. The Steward’s decision will be final and binding with respect to the eligibility of the horse.
  28. Standardbred horses that are 2YO or older and un-raced must be certified by the Stewards as eligible to be included in the scheme. The Steward’s decision will be final and binding with respect to the eligibility of the horse.
  29. Standardbred rising 2YO horses that are currently being educated can be considered as horses In Work and are eligible to be nominated in the scheme on approval by the Stewards. The Steward’s decision will be final and binding with respect to the eligibility of the horse.
  30. Tasracing acknowledges that standardbred horses may go out of work and/or another come In Work and/or be transferred to another trainer if the cessation of racing is extended beyond the Term. In the event of these situations, the Trainer must notify Tasracing of the changes by completing the Update Form as soon as possible. If the updates are not notified to Tasracing and there is a discrepancy between the nominated horses in the Application Form and the horses In Work on inspection by the Stewards, the Trainer will be required to repay any overpayment as determined by Tasracing in consultation with ORI.
  31. The day rate for a standardbred horse In Work is $35 per calendar day plus GST (where applicable).
  32. Greyhound Racing Welfare Package Criteria

  33. Payments under the Welfare Package will be made to Trainers as the responsible person for welfare for greyhounds In Work.
  34. Trainers must apply for the Welfare Package and nominate each greyhound (whether a racing dog, breeding dog or pup over six (6) weeks of age.
  35. The weekly rate for a greyhound over the age f four (4) months is $50 per week per dog plus GST (where applicable). Pups under four (4) months but over 6 weeks of age (based on date of whelping notice) will receive a payment of $20 per week per pup plus GST (where applicable).
  36. Unnamed pups over the age of four (4) months that are registered on OzChase are eligible to be nominated for the scheme and will be paid at the weekly greyhound rate of $50 per dog.
  37. Tasracing will validate all applications for the Welfare Package against OzChase and the last six (6) months of racing data.
